Subclass 309 and 100

Overview

  • Subclass 309 (Temporary): Allows the applicant to live in Australia while awaiting a decision on the permanent visa.

  • Subclass 100 (Permanent): Grants indefinite stay once the relationship is confirmed to be genuine and ongoing.

You apply for both visas together, but they’re assessed in stages.

Eligibility Criteria

To qualify, you must:

  • Be in a genuine and continuing relationship (married or de facto) with an eligible sponsor.

  • Be outside Australia when applying for the 309 visa.

  • Meet health and character requirements.

  • Be sponsored by your partner, who must be:

    • An Australian citizen

    • An Australian permanent resident

    • An eligible New Zealand citizen

Application Process

  1. Prepare Documentation:

    • Proof of relationship (photos, joint finances, travel history, etc.)

    • Identity documents

    • Health and police checks

  2. Submit Online Application:

    • Lodge both 309 and 100 visas together via the Department of Home Affairs portal.

  3. Wait for Processing:

    • Subclass 309: Typically takes 12–18 months

    • Subclass 100: Usually granted 2 years after 309, unless in a long-term relationship

Common Challenges

  • Processing Delays: Due to high demand or incomplete documentation

  • Evidence Requirements: Must be thorough and consistent

  • Sponsor Limitations: Sponsors can only support two partner visas in their lifetime, with a 5-year gap between them
